1. Introduction and Acceptance

Welcome to TigerMail. These Terms of Service ("Terms") govern your access to and use of the TigerMail email service platform ("Service"), operated by Raam Intelligence Ltd. ("we," "us," or "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website or by email. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

2. Definitions

  • "Service" refers to the TigerMail email platform, including the web dashboard, API, and all related features and functionality.
  • "User" or "you" refers to any individual or entity that accesses or uses the Service.
  • "Account" refers to your registered account on the Service.
  • "Organization" refers to the business entity associated with your Account.
  • "API" refers to the Application Programming Interface provided by TigerMail for programmatic access to the Service.
  • "Content" refers to any data, text, emails, attachments, or other materials transmitted through the Service.

3. Account Registration

3.1 Eligibility

To use the Service, you must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using the Service, you represent and warrant that you meet these requirements.

3.2 Account Information

You must provide accurate, complete, and current information when creating your Account. You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account.

3.3 Account Security

You must immediately notify us of any unauthorized use of your Account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your Account credentials.

4. Service Description

TigerMail provides an email sending and management platform that includes:

  • A web-based dashboard for composing, sending, and managing emails
  • A REST API for programmatic email sending and management
  • Domain verification and DKIM/SPF configuration tools
  • Email delivery tracking, analytics, and reporting
  • Email inbox functionality for receiving and managing incoming emails
  • API key management for secure access to the API

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

5. Acceptable Use Policy

You agree not to use the Service to:

5.1 Prohibited Content

  • Send spam, unsolicited emails, or bulk commercial messages to recipients who have not opted in
  • Send emails containing malware, viruses, or other harmful code
  • Send phishing emails or emails designed to deceive recipients
  • Send content that is illegal, defamatory, harassing, threatening, or obscene
  • Send emails that infringe on intellectual property rights
  • Send emails to purchased, rented, or harvested email lists

5.2 Anti-Spam Compliance

You must comply with all applicable anti-spam laws, including but not limited to:

  • The CAN-SPAM Act (United States)
  • GDPR consent requirements (European Union)
  • CASL (Canada)
  • Any other applicable local anti-spam legislation

All marketing and promotional emails must include a clear and functional unsubscribe mechanism. You must honor unsubscribe requests within 10 business days.

5.3 Volume and Rate Limits

Your use of the Service is subject to volume and rate limits based on your subscription plan. We reserve the right to throttle or suspend accounts that exceed their limits or engage in abusive sending patterns.

6. Payment Terms

6.1 Pricing

The Service offers various pricing plans, including a free tier with limited features. Paid subscriptions are billed on a monthly or annual basis. All prices are in US Dollars (USD) unless otherwise specified.

6.2 Billing

Payment processing is handled by our payment provider, Paddle. By subscribing to a paid plan, you agree to Paddle's terms of service. Subscriptions automatically renew unless cancelled before the renewal date.

7. API Terms

7.1 API Access

Access to the TigerMail API is provided through API keys. You are responsible for keeping your API keys secure and must not share them with unauthorized parties.

7.2 Rate Limits

API usage is subject to rate limits based on your subscription plan. Exceeding rate limits may result in temporary throttling or suspension of API access.

7.3 Restrictions

You may not resell, redistribute, or sublicense API access without our prior written consent. You may not use the API in a way that could damage, disable, or impair the Service.

8. Intellectual Property

8.1 Our Rights

Raam Intelligence Ltd. and its licensors own all rights, title, and interest in and to the Service, including all intellectual property rights. The Service is protected by copyright, trademark, and other laws.

8.2 Your Content

You retain ownership of any Content you transmit through the Service. By using the Service, you grant us a limited license to process and transmit your Content as necessary to provide the Service.

8.3 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to you.

9. Data Processing

Our collection and use of personal data is described in our Privacy Policy. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

10. Service Availability

We strive to provide reliable service, but we do not guarantee uninterrupted or error-free operation. The Service may be subject to scheduled maintenance, upgrades, and occasional unplanned outages.

We are not liable for any damages resulting from service interruptions, data loss, or delays in email delivery.

11. Termination

11.1 Termination by You

You may cancel your Account at any time through your account settings or by contacting us. Your access to the Service will continue until the end of your current billing period.

11.2 Termination by Us

We may suspend or terminate your Account immediately if you violate these Terms, engage in fraudulent or illegal activity, or if we are required to do so by law.

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your Account data after a reasonable retention period. Provisions of these Terms that by their nature should survive termination shall survive.

12. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAAM INTELLIGENCE LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

WE DO NOT GUARANTEE EMAIL DELIVERY. WE ARE NOT LIABLE FOR EMAILS THAT ARE NOT DELIVERED, DELAYED, OR MARKED AS SPAM BY RECIPIENT EMAIL PROVIDERS.

13. Indemnification

You agree to indemnify, defend, and hold harmless Raam Intelligence Ltd., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Tel Aviv, Israel.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Raam Intelligence Ltd. regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
